إن التعهد بضم المستوطنات هو مجرد واحد من العديد من الوعود الانتخابية التي قطعها رئيس الوزراء بنيامين نتنياهو على مدار السنوات والتي قد لا يتم الوفاء بها على الإطلاق، كما قال خصومه السياسيون مساء الثلاثاء.

كيف تقوم دولة بضم، أو تطبيق السيادة على، قطعة أرض لم تكن في السابق جزءا من أراضيها؟
ببساطة، عندما تعتبر دولة أن منطقة ما تتبع لها وتتصرف وفقا لهذا الإعلان، فيمكن اعتبار ذلك ضما.

يقول يوجين كونتورفيتش، وهو أستاذ قانون أمريكي-إسرائيلي ومدير مركز القانون الدولي في الشرق الأوسط بجامعة جورج ميسون “لا توجد هناك صيغة سحرية للضم”.
وقال إن أي دولة يمكنها ضم الأراضي دون تطبيق قانونها الداخلي عليها، مشيرا إلى أن معظم الأراضي الأمريكية خضعت للقانون العسكري لعدة عقود، وأضاف أن بإمكان الدولة أيضا تطبيق قوانينها على منطقة معينة دون ضمها بالضرورة.
ولكن عندما تقوم دولة بتطبيق قوانينها وتصف هذه الخطوة بأنها “عمل سيادي”، كما فعل رئيس الوزراء الإسرائيلي السابق مناحيم بيغن مع قانون هضبة الجولان لعام 1981، “فهذا هو ضم واضح”، كما قال كونتوروفيتش.

كما أشار ليبليخ إلى أنه على الرغم من أن إسرائيل لم تعلن قط رسميا أن الضفة الغربية هي أرضها السيادية، فإن البعض يعتبرون سيطرة إسرائيل على المنطقة المستمرة منذ نصف قرن والتوسع المستمر في المستوطنات “ضما بحكم الأمر الواقع”، وأضاف “بعض الناس يقولون بالفعل إن إسرائيل تتعامل مع الأرض باعتبارها تابعة لها”.
