الزكاة ركن أساسي من أركان الإسلام، وهي الركن الثالث بعد الشهادتين والصلاة. وقد شرّعها الإسلام لما فيها من فك ضوائق المحتاجين، وتفريج همومهم، كما أنها تطهّر النفس وتبارك المال، مصداقا لقوله تعالى: “خُذْ مِنْ أَمْوَٰلِهِمْ صَدَقَةً تُطَهِّرُهُمْ وَتُزَكِّيهِم بها”.
تُلقي الظروف الاقتصادية الصعبة التي يعيشها شعبنا الفلسطيني بكاهلها على كافة الأمور الحياتية، فلم يسلم قطاع دون أن يتأثر بما نعيش من أزمات متتالية، ومنها تراكم ديون الطلبة في الجامعات، وتعثرهم في سدادها؛ ما يترتب احتجاز شهاداتهم الجامعية، وعدم تمكنهم من الالتحاق بوظائف تساهم في تحسين واقعهم المعاش.
ومن هنا قد يتبادر إلى الأذهان هذا السؤال، هل يجوز إخراج زكاة المال على هيئة تحرير شهادات جامعية لطلبة متعثرين ماليا؟
وللإجابة على هذا التساؤل، مع الدكتور ماهر السوسي، أستاذ الفقه المقارن في كلية الشريعة والقانون في الجامعة الإسلامية بغزة، حيث قال :”إن لم تكن لهؤلاء الطلبة الفقراء أولويات سوى تحرير شهاداتهم الجامعية المحتجزة، فيجوز هذا الأمر”.
غير أنه أكدّ على أن “الأصل بأن تُدفع زكاة المال للفقير نفسه، وهو من يقوم بالوفاء باحتياجاته؛ إذ لا يجوز أن نحدد له احتياجاته. فيتحتم علينا أن ندفع الزكاة لمحتاجها، الذي بدوره يحدد أوجه إنفاقها بناء على احتياجاته، إن كان يريد استخراج شهادته الجامعية، أو سداد فواتير أو ديون”.
وأضاف السوسي بأن “هناك احتياجات كثيرة لكل فقير، منها الأساسي، ومنها ما هو ثانوي، وبناء عليه لا نستطيع تقدير الحاجة المُلّحة للفقير، لذلك نقدم الزكاة له، وهو من يقوم بترتيب احتياجاته، والوفاء بها”.
وفي الوقت ذاته، شدّد السوسي على أنه “ليس من السليم أن يكون هناك توجه عام لدفع زكاة المال على هيئة استخراج الشهادات الجامعية للطلبة المتعثرين؛ تبعا لوجود احتياجات وأولويات للفقير، قد لا تكون تحرير الشهادات المحتجزة”.
غير أنه أضاف، “أنه، وكحالة خاصة، إن كانت فرصة حصول الطالب المتعثر على وظيفة يعتاش بها، متوقفة على تحرير شهادته الجامعية، فيجوز دفع مال الزكاة له؛ كي يستخرج شهادته”.
وفي ذات السياق، يرى الدكتور محمد العمور، أستاذ الفقه الإسلامي، بأن “تحرير شهادات الطلبة الفقراء يُدرَج ضمن فئة الغارمين، وهي فئة متعددة الشرائح، فهناك غارمون موقوفون في السجن؛ لتخلفهم عن سداد المال، منهم المريض أو رب الأسرة، فالأولى أن تُدفع الزكاة لهم”.
وتابع العمور قوله: بأن “الطلبة المتعثرين في تحرير شهاداتهم ليسوا أولوية على الرغم من صحة إنفاق الزكاة على هذا الوجه، إذ إن مصارف الزكاة ثمانية، والغارمون الوجه السادس من أوجه إنفاقها”.
وقد حدد الشرع مصارف الزكاة الثمانية، كما جاء في قوله تعالى: “إنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ فَرِيضَةً مِنَ اللَّهِ وَاللَّهُ عَلِيمٌ حَكِيمٌ”.
