عقدت المحكمة العسكرية الدائمة التابعة لهيئة القضاء العسكري في غزة ، اليوم الأربعاء 20 يوليو 2022، أولى جلساتها للنظر في قضية مقتل مواطن وطفلة من عائلة “دردونة” وإصابة 11 آخرين، شمال غزة بتاريخ 14 يوليو الجاري.
ووجّهت النيابة العسكرية للمُتهم الأول في القضية (جبريل، ق) عسكري برتبة رقيب أول، مواليد عام 1996م، من سكان بلدة جباليا شمال غزة، التُّهم التالية:
1) القتل قصداً خلافاً لنص المادة (378/أ) معطوفاً عليها المادة (124) من قانون العقوبات الثوري لعام 1979م.
2) محاولة القتل خلافاً لنص المادة (378/أ) معطوفاً عليها المادة (70) من نفس القانون.
3) إيقاع أذى بليغ خلافاً لنص المادة (386) معطوفاً عليها المادة (388) من نفس القانون.
4) حمل سلاح ناري في مناسبة غير مشروعة خلافاً لنص المادة (89) من قانون العقوبات رقم (74) لعام 1936م.
5) حيازة سلاح ناري بدون ترخيص خلافاً لنص المادة (25/2) من قانون الأسلحة والذخائر رقم (2) لعام 1992م.
6) إقلاق الراحة العامة خلافاً لنص المادة (102/1) من قانون العقوبات رقم (74) لعام 1936م.
7) إطلاق نار في منطقة مأهولة بالسكان خلافاً لنص المادة (380) من قانون العقوبات رقم (74).
في حين وجّهت النيابة العسكرية للمتهم الثاني وهو (محمد، ق) مدني، مواليد عام 1974م، من سكان بلدة جباليا، تُهمتَي:
1. الذم خلافاً لنص المادة (258) معطوفاً عليها المادة (404) من قانون العقوبات الثوري لعام 1979م.
2. حمل أداة مؤذية خلافاً لنص المادة (89) من قانون العقوبات رقم (74) لسنة 1936م.
وتستمر المحكمة بعقد جلساتها في القضية بشكل يومي لحين الانتهاء والنطق بالحكم.
