استنكر مركز الميزان لحقوق الإنسان، اليوم الاثنين، استمرار إصدار أحكام الإعدام في قطاع غزة مطالباً بوقفها تماماً.
جاء ذلك في بيان له، بعد إصدار حكم جديد بالإعدام في القطاع، وفيما يلي نص البيان الذي وصل “دنيا الوطن” نسخة عنه:
أصدرت محكمة الاستئناف في قطاع غزة صباح يوم الأحد الموافق 17/04/2022، حكماً بالإعدام شنقاً بحق المواطن (ي . ش) (31 عاماً)، من سكان مدينة غزة. إذ أدين من هيئة المحكمة بالتهم المسندة إليه في قضية قتل المواطن نور الدين ناهض أيوب عودة (28عاماً)، بتاريخ 5/1/2018.
وجاء الحكم بالإعدام شنقاً حتى الموت، لإدانته بتهمة القتل قصداً وحمل أداة مؤذية في مناسبة غير مشروعة والمشاجرة في مكان عام خلافاً لمواد القانون الفلسطيني.
تجدر الإشارة إلى أن محكمة أول درجة كانت قد قضت حكماً في وقت سابق بالحبس المؤبد على المدان عن كافة التهم المسندة إليه في لائحة الاتهام مع مصادرة أداة الجريمة، إلا أن محكمة الاستئناف عدلت الحكم من حيث العقوبة، ليصبح الإعدام شنقاً.
وبهذا الحكم يرتفع عدد أحكام الإعدام في قطاع غزة إلى (4) أحكام منذ بداية العام الحالي 2022، و(38) حكماً منذ انضمام دولة فلسطين بتاريخ 18 مارس 2019، إلى البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية لعام 1989، وهو سلوك يتعارض مع التزامات دولة فلسطين الناشئة عن الانضمام.
مركز الميزان لحقوق الإنسان إذ يعيد التأكيد على موقفه المبدئي المناهض لعقوبة الإعدام، فإنه يعبر عن قلقه لاستمرار العمل بهذه العقوبة، كونها عقوبة سالبة للحياة ولا يمكن التراجع عنها بعد تنفيذها، كما أنها لا تحقق الردع، فضلاً عن أنها تخالف التزامات دولة فلسطين بموجب القانون الدولي لحقوق الإنسان، ولا سيما العهد الدولي الخاص بالحقوق المدنية والسياسية، والبروتوكول الثاني الملحق في العهد.
وعليه، فإن المركز يطالب بوقف إصدار أحكام الإعدام بشكل فوري وكامل والامتناع عن تنفيذ السابقة، تمهيداً لإلغائها من المنظومة التشريعية الفلسطينية، وإيجاد عقوبات أخرى تحترم التزامات دولة فلسطين القانونية، وتكون أكثر نجاعةً في الحد من الجرائم الخطيرة.
